The Trump administration told a Texas judge to throw out a case from three states seeking to restrict access to the abortion medication mifepristone.
The Department of Justice argued the three Republican-led states—Idaho, Kansas and Missouri—had no standing to bring their case in a Texas court. Filed in the Northern District of Texas, the plaintiffs urged the court to restrict access to the drug at certain points in pregnancy and to reinstate in-person requirements for access to mifepristone, claiming that mail-order access violates their respective state-level abortion bans.
However, the DOJ preserved federal regulations that allow abortion pills to be mailed, affirming Biden-era decisions. The Supreme Court previously ruled to preserve access to mifepristone following a lawsuit from a group of anti-abortion doctors, the Alliance for Hippocratic Medicine, who claimed that the health impact of mifepristone had not adequately been studied.
To the ire of his anti-abortion supporters, Trump has said that he would not outlaw abortion medication.
