Attorney slams Guam Behavioral Health for failing to get certified
Guam - Its been four years since GovGuam took back control of Guam Behavioral Health and Wellness Center from a federal management team, but until now they have not achieved CMS accreditation as they promised to do years ago.
That from Attorney Dan Somerfleck who sued GovGuam in 2001 for constitutional violations of the Americans with Disabilities Act. The case dragged on for years in federal court and in 2010 a Federal Management Team was appointed to take over management of the department.
After three years of court-ordered improvements, Behavioral Health was eventually handed back to GovGuam under the condition that they obtain accreditation from the Centers for Medicaid and Medicare. Somerfleck filed a motion earlier this week for order to show cause for contempt of court against Guam Behavioral Health for failing to obtain CMS certification.
In court papers, Somerfleck points out that over the last four years, like a broken record, Behavioral Health has repeatedly asserted its intent to obtain certification, but year after year has failed to do so.
