Oregon launches legal weed July 1

WHAT’S LEGAL?

Under Measure 91, starting July 1, anyone over 21 in Oregon can possess up to 8 ounces of usable marijuana, such as dried buds at home and up to one ounce outside the home. You can consume marijuana at home or on private property. You can grow up to four plants per residence at home out of public view. You can make brownies and other edible products at home and receive them as gifts. And you can give away marijuana and receive it as a gift.

WHAT’S NOT LEGAL?

It is illegal to buy or sell recreational marijuana and to transport it across state lines. That includes buying some from a legal retail outlet in Washington state and bringing it home to Oregon. It is illegal to smoke marijuana in public or to drive while stoned. Measure 91 will not protect you if your employer prohibits drug use, especially if there is a federal connection, because marijuana remains illegal under federal law. And if your landlord prohibits smoking in your apartment, you can be evicted for smoking marijuana, but not for eating it.

WHEN CAN I BUY IT LEGALLY?

There is no hard date.The OLCC does not expect to have the chain of retail recreational marijuana growers, processors, wholesalers and sales outlets permitted and operating until late in 2016. There has been talk in the Legislature about jumpstarting that by allowing recreational marijuana sales through medical marijuana dispensaries as early as October, but that remains up in the air.

So you can possess it, but not buy it, in Oregon. Oooooo-kay.

3. Uh, it's not "relative chaos". It's way better than the 46 states where it's still illegal.

It was known from the get-go that there was going to be a delay between implementation of the law, and the beginning of licensed sale for recreational use. This is not news. There was a similar delay in Washington state, IIRC.

In the meantime, as noted, the legislature is working on proposals to allow limited recreational sales by the medical mj dispensaries until the full regulatory and sale apparatus is up and running.

I haven't been following the Oregon experience like I followed the developments in Colorado. Oregon is having a few more bumps than Colorado did, but I'm sure it'll get worked out.

5. Fair enough, but I'll reiterate that these aren't really "bumps" IMHO. Everyone knew when 91 passed,

that there would be lag time between legalization and regulated stores coming online.

Can I get my Medical Card if I am not an Oregon Resident?

YES! You will need to pay a visit to one of the state’s 15 or so medical marijuana clinics, fill out an application and see a doctor. Hundreds of people do this every year, and have since June of 2010 when the state first started to allow it.

Tourists can get a Medical Card? And you don't need a Medical Card from another state to do it?

One additional fun fact is that Oregon’s Medical Marijuana Card is also accepted by dispensaries in Michigan, Maine, Montana, Rhode Island and Arizona!

Below is a list of qualifying conditions:
Chronic Pain, Glaucoma, Cancer, AIDS/HIV, Chronic Muscle Spasms, Multiple Sclerosis, GERD, Seizures, Crohn’s Disease, Chronic Nausea, Cachexia, Asthma, IBS, Hepatitis C, Parkinson’s Disease, Arthritis, Fibromyalgia, Migraines, Epilepsy, Degenerative Disk Disease and others.

Do you have any info on if tourists will be able to buy similar quantities as residents? I think I understand that Washington state allows residents and tourists to purchase up to one ounce at a time, a lot nicer than Colorado's 1/4 oz limit for tourists.

Oregon Medical Possession Law
The Patient Possession limit is twenty-four ounces of usable cannabis (1.5 pounds)
Cultivation: Six (6) mature cannabis plants, 18 immature seedlings

Recreational Possession Law, Initiative 91
Flower-One ounce of dried usable marijuana away from the home (28 Grams), and eight ounces (a half-pound) of dried usable marijuana at the home
Extracts and Concentrates – 1 ounce(28 grams) of extract for inhalation
Edibles- 16 oz of infused product in edible form or 72 oz in beverage form
Cultivation: Four(4) marijuana plants total per household

14. Good question, I dont believe there is any residency requirement written into oregon's law.

I believe it is like Wasington's in that regard, in that if you're 21 it doesn't matter what state you are from, the law treats you equally... You just need to keep it in the state. I suspect here it's not as much of a question of worry that people from surrounding conservative states will do the "pot tourism" thing, like Colorado is probably concerned with- as noted, it's already legal in WA and odds are pretty decent that California will be going fully legal before long. I suppose folks could come in from Montana, but my hunch is that most of the legal mj establishments are going to end up in the western half of the state.

6. It's still like that in Alaska, too.

Our law went into effect in February, but they're still working out the regulations for selling, etc. same thing here about the public consumption, etc.

Legalization is a good first step, and I guess the intricacies will "evolve."

They basically legalized ownership without legalizing commerce.

Those in Oregon should be happy. Most of the other states bouncing MMJ (and even legalization) about still have restrictions on home grow. Ironic - can't buy, can't sell, can't grow - but you can't be arrested for 'magically' being in possession...

8. Commerce is legal here, too, it just hasn't been implimented yet.

There's a framework and a state organization- the OLCC- which will be handling the permits, etc.

We knew there was going to be a delay, but I absolutely believe that our state will be able to get it moving in short order.

On the ground the situation is akin to Alaska, for now, but in actuality the process is closer to what happened in Washington State in 2012-2013. They legalized but it took them a while to get the stores up and running.

12. As far as I know, local law enforcement has made pot a real low priority for a while.

And judging by the fact that OR is either #1 in per capita pot smoking or else #1 for cheap weed- cant remember which, maybe both-- I dont think people have been having much trouble finding it, even before measure 91.

It is worth noting that the legislature seems to be moving forward with expedited, limited rec. sales from mmj dispensaries-
