John Bonifaz--a constitutional law expert and President of Free Speech For People--explained to SiriusXM radio's Dean Obeidallah that given Trump engaged in an insurrection, he is barred from federal office by way of Sect 3 of the 14th Amendment unless 2/3's of Congress in each chamber votes to remove that bar. That means if Trump is sworn in without such a vote, he will be an illegitimate President and all of his actions in the White House will be legally invalid.


The fight isn't over. It's just getting started.

Our best shot at blocking him was on Jan 6, 2025 when Congress convened to certify the Electoral votes.
ZERO Congress members objected. We needed a document stating the reason for objection, with 87 signatures from the House and 20 from the Senate.
The Reason?
That's easy, he sent his goons to storm the US Capitol building on J6 2021.
Insurrection against the Constitutional process that was happening at that moment, after swearing to defend the Constitution is a breach of oath of office. That is a disqualification for which there is only one remedy a 2/3 vote in both chambers to remove his LEGITIMATE banishment from office.
He will always be illegitimate until that bar is removed, so that none of his actions in office will have any legal force.
Some try to argue he was never CONVICTED of insurrection.
Yes he was, 3 times.
a) In the House Select Committee on January 6th and twice when citizens sued to keep him off the ballots. Both judges found trump guilty of insurrection, even though both (CO & Maine) ultimately & Wrongfully lost on appeal to scotus.
SCOTUS ruled that Congress was the place to decide his viability.

When in fact,

"Nothing in the Fourteenth Amendment suggests that federal
legislation is required for enforcement of Section Three."

NOW, It would have been a helluva lot easier to challenge him in the proper forum, but we cant just roll over and quit.
