Griffin: Private schools receiving state education voucher funds not subject to FOIA

Private schools that accept state voucher funds are not subject to the Arkansas Freedom of Information Act, according to Attorney General Tim Griffin.
The attorney general's opinion, which was released on Aug. 26, came at the request of State Sen. Clarke Tucker, D-Little Rock, who put the question to the attorney general's office in October of last year.
Tucker said the issue has become salient with the passage of the LEARNS Act, an expansive education law that allows students to use state dollars to attend a private school or be home schooled. The law's universal voucher program, known as Educational Freedom Accounts, is being phased in over a three-year period, with it becoming open for all students in the 2025-2026 school year.
