A unanimous court saved mifepristone. But more formidable challenges to abortion medication loom.

reathe a sigh of relief over the Supreme Court’s decision to toss out a challenge to the abortion medication mifepristone. Then take a deep breath, because this isn’t the end of efforts to interfere with access to medication abortion.

First, the good news — and it is good, although it should never have been necessary. The justices found that antiabortion doctors and their medical organization lacked standing to bring a challenge to the Food and Drug Administration’s moves to make it easier for women seeking abortions to obtain abortion medication, which now accounts for more than 60 percent of all abortions.

Notably for this court, the ruling in FDA v. Alliance for Hippocratic Medicine was unanimous. The outcome is a sharp if implicit rebuke to the out-of-control U.S. Court of Appeals for the Fifth Circuit, which had stretched — tortured, really — the law of standing to find that the doctors and their group, created in the wake of the court’s 2022 ruling eliminating the constitutional right to abortion, could bring suit.

The bigger threat is the Republican Party. Trump doesn’t cre what happens with abortion so long as he’s seen as being in the side of the issue. If elected, he will sign whatever crazy abortion and contraceptive bills Republicans pass. If they passed a bill requiring that any woman who has an abortion for any reason, even to save her life, be sentenced to death as Abortion Abolitionists gave proposed), he would sign the bill. The real threat are Republicans in the states and in Congress if they have majorities and Trump is elected. They will pass the most draconian laws we have ever seen, and the Supreme Court will uphold them. The media has a tendency to talk mostly about Trump and rarely about the whacko Republican Party.
