Trump's attorneys have reviewed draft of Smith's final special counsel report and want it blocked from public release

Lawyers for Donald Trump have reviewed a draft of special counsel Jack Smith’s final report related to federal investigations into the president-elect and are threatening legal action if he releases it, according to a letter included in court filings from Trump’s former co-defendants Monday night.

In the filings, Walt Nauta and Carlos De Oliveira ask Judge Aileen Cannon to block the release of the special counsel report, which was expected in the coming days before Trump is sworn in as president for the second time. The two men, who both worked for Trump and have pleaded not guilty to obstruction related crimes, argued in the filings that Smith does not have the authority to release the report because Cannon previously deemed his appointment as special counsel unlawful.

He’s more likely to bury this one as well since he doesn’t want to look political. Smith should just release it himself, mostly unredacted, and head back to The Hague for his own safety.

We have watched the arch-defendant slink and slither away from justice so often that most of realized the battlefield to defeat Trumpf was going to be in the election booth, not the courtroom (e.g. federal, state, county).

And no matter how scathing the SC report is, and whether it was released before 5 Nov 2024, MAGA Republicans were going to vote for Trumpf anyway.



Trumpf's numbers increased every election:

"Viewed in raw numbers, Trumpf got about 63 million votes in 2016, 74 million in 2020 and nearly 77 million in 2024."

Meanwhile, the Democratic Party turnout for Harris/Walz was drastically lower in 2024 than it was for Biden/Harris in 2020:

"Vice President Kamala Harris received about 6.8 million fewer votes than Joe Biden in 2020, while President-elect Donald Trump gained around 2.8 million compared with 2020."

For example, Kamala Harris captured 55% of New York State’s votes to Trump’s 45%, the thinnest blue majority since 1992.

Americans deserve to read the unredacted Special Counsel report on Trumpf as as soon as possible as this is the result of our hard-working taxpayer funds at work. But releasing the report before that crucial Tuesday would not have tipped the scale for Kamala Harris.

And then read that the two lawyers are to be named #2 and #3 at DOJ, so I guess because they are incoming they get to see it just like other appointments. Its obvious why those two would be appointed. Its all complete bullshit and corruption.

And this has nothing to do with Judge Cannon.

Why is Trump so scared? He is going to be the President and thus able to quash anything anyone does.

Is there something so bad that it would cause a revolt in the next two weeks that could pre-depose him?

I think it's just reflex and other than the grisly details we know everything. Trump is, per usual, worried about appearances. He doesn't need to do any news or press conferences; he's limiting who gets to ask questions in the press room, so he's going to be a mad dictator in a tower while all his flying monkeys carry out destruction.

I heard that was in Smith's report and that's why Trump doesn't want it to be released. Melania might ask for a divorce if that gets out.

I'm sure it would exonerate the Jan 6th committee, since all this started based on what the 1/6 committee found, embarrassing Garland into actually doing something, 1.5+ years after it happened.

Let’s not brush too quickly past the fact that the former criminal defendants brought the matter to Cannon — a highly controversial Trump-appointed conservative judge whose handling of the Republican’s classified-documents case was widely condemned by legal experts.,,,,,

It’s difficult to say what might happen next, though The New York Times’ report noted that Team Trump appears to have “an uphill battle.”

The article explained:

Mr. Trump’s lawyers have no power to force Mr. Garland to stop the report from coming out, and their letter amounted to little more than a belligerent request. It is also unclear whether Judge Cannon would have the authority to tell the attorney general how to handle a report by a special counsel that he himself appointed, especially when the case is technically out of her hands and in front of an appeals court.


As for the near future, it’s also an open question what Trump might try to do after his Inauguration Day: A couple of weeks before Election Day 2024, the then-GOP candidate said he wanted Smith to be “thrown out” of the United States.

If you think the report would make Trump look bad, just imagine what it would do to Merrick Garland. To have such vast amounts of incontrovertible evidence and to have insured that nothing was done is almost certainly the biggest betrayal of their country, by any person in history.
Garland knowingly oversaw the protection of a group of individuals intent on seizing the country for their own personal desires. My disgust at Garland is only matched by my disgust at the "podcast lawyers" who of four years have told their listeners that we are are too ignorant to understand the legal system and that we should not be impatient. They preached down to us, condemning those who pointed out that was nothing was being done. Through four years when public outcry and protest may have spurred Biden to remove Garland, those faux liberal law mongers did everything they could to quell the slightest complaint.
They sold lies along with their vitamin supplements and magical products.
And now they are trying to reframe their "mission statements" with fresh promises of how if we buy a subscription they will lead us to the promised land. They have been enablers of a DOJ that had shown its plan to do nothing.
Garland will not release the report, Trumps new AG will insure that it is classified or destroyed. The final act after years of being told that checks and balances would save us. That Mueller would save us. That two impeachments would save us. That the J6 committee would save us. That New York trials would save us. That Georgia trials would save us. That Florida trials would save us.
Nobody is coming to save us, and if they say they are, they are lying to encourage your inaction.

I hope Jack Smith's self reservation instincts are so strong that he does the following:
1. Load all pertinent information and documentation onto a couple of thumb drives.
2. Take his family and move to Great Britain or Holland.
3. Arrange publication with a British publisher.
4. Move to an isolated community or the Highlands, maybe Northern Ireland.

The attorneys on DU can comment better on this, but SC Jack Smith seemed to have rendered a professional courtesy to his legal adversaries by allowing them to read the report and voice their objections before national publication (which they did).

Unfortunately, if/when released there will be redactions to protect sources and methods.

If somehow Jack Smith is blocked from releasing it, I imagine a staff member might leak the report like in 2023 when someone leaked damaging SCOTUS memos regarding Roe vs. Wade.
