Press secretary Karoline Leavitt stepped on a legal landmine during her first White House press briefing Tuesday when she declared the administration doesn't believe in the constitutionality of birthright citizenship.

Birthright citizenship is outlined in the 14th Amendment and guarantees, "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

But according to Leavitt, "This administration believes that birthright citizenship is unconstitutional."

But critics let her have it on social media.

Rep. Summer Lee (D-PA) posted a screen capture of the 14th Amendment, remarking, "The literal Constitution."

was originally written to protect freed slaves, and therefore shouldn't apply to people missing a few papers. That could persuade Thomas and a few other SC Nazis.

"Not under the jurisdiction of" means "not subject to the laws of," such as foreign ambassadors and their families/staff. So if these migrants are not "under the jurisdiction of" the United States, they can't be prosecuted for what they do here. Hell, if I knew I was going to be deported and I knew that I couldn't be prosecuted, I'd go on one hell of a crime spree before saying goodbye.

i wonder how many of those proud boys and such claim to be "sovereign citizens" and not in the jurisdiction. those are the ones i'd like to deport.

In 17 amended campaign filings on January 23, 2025, Leavitt disclosed $326,370 in unpaid campaign debts she had previously failed to disclose for several years. Roughly $200,000 of the debt was composed of illicit campaign donations made in excess of campaign finance limits she never paid back in violation of campaign finance laws. She previously faced an FEC complaint in 2022 from End Citizens United alleging Leavitt's campaign and treasurer illegally accepted campaign donations over the legal limit and never repaid her donors.
