1. New congress will be sworn in 1/3, so probably the filibuster is history before the electoral count on 1/6

After electing a speaker majority leader, the first order of business is to set up the rules of the new regime.

These will be defined well in advance of that date.

Then there will be nothing to hide behind for the 2026 midterms, and their yes/no votes will be public record for all to see.

And then when Dems take back the senate, the filibuster will already be dead and buried.

Win/win.

I fully expect Trump and/or Vance to declare Martial Law or concoct some other reason to cancel/block elections.

They might troll democrats with such a vote - but there’s no need to kill the filibuster until there’s a vote that they can’t win without killing it. And that’s many months away
